1. ACCEPTANCE OF TERMS
By accessing or using TTB's platform, you agree to these Terms & Conditions.
2. DESCRIPTION OF SERVICES
TTB provides a platform enabling:
- Tenants to pay rent and related expenses
- Landlords or their duly authorized representatives, including property managers /payees, to receive payments
- Landlords or their duly authorized representatives, including property managers, to pay special assessments, condo fees, utilities, and related costs.
- Landlords or their duly authorized representatives, including property managers, to list properties and connect with prospective tenants.
TTB is not a bank, escrow service, fiduciary, insurer, or guarantor of any payment outcome.
3. USER OBLIGATIONS
You agree to:
- Provide accurate and truthful information
- Submit valid ID documents
- Secure your devices and login credentials
- Use TTB only for lawful, authorized payments
TTB is not responsible for any loss caused by user negligence or misrepresentation.
4. PAYMENT PROCESSING
TTB:
- Processes payments exclusively through a third‑party Payment Card Industry Data Security Standard (PCI‑DSS)‑compliant payment processor. Users enter payment credentials directly into the processor's secure environment; TTB does not collect, store, or transmit payment card information.
- Forwards payments to landlords or their duly authorized representatives, including, without limitation, property managers, management companies, or other legally authorized payees.
- Has no control over, and bears no responsibility for, the landlord's or their authorized representatives' acceptance, application, allocation, or handling of payments once forwarded.
- Is not liable for delays, interruptions, or processing issues caused by banks, financial institutions, networks, or third‑party processors.
All fees are clearly and transparently disclosed before you proceed to payment and again at checkout.
5. VERIFICATION REQUIREMENTS
- Users must complete identity and document verification as required under Anti‑Money Laundering (AML) and Know Your Customer (KYC) obligations. AML requirements are intended to prevent fraud, money laundering, and other illicit activities, while KYC rules require verification of a user's identity before certain transactions can be processed.
- Verification is conducted through our third‑party identity verification provider. Users submit their information directly through the provider's secure verification flow. TTB only receives the verification outcome (e.g., verified/not verified) unless additional review is required. TTB does not collect or transmit identity documents; however, our verification partner may provide us with secure, limited access to view submitted documents within its portal, as necessary to complete or confirm verification.
- Payments may be paused, delayed, or declined if verification is incomplete, unsuccessful, or requires additional review.
6. PROHIBITED USES
You are strictly prohibited from using TTB to:
- Create or facilitate false tenancies, fictitious payees, or any misrepresentation of the landlord, tenant, or authorized representative relationship.
- Engage in fraud, identity misrepresentation, or any attempt to bypass identity‑verification requirements.
- Interfere with, disrupt, or attempt to compromise the security, integrity, or proper functioning of the platform.
- Violate any applicable laws or regulatory obligations, including Anti‑Money Laundering (AML) and Know Your Customer (KYC) requirements.
7. SECURITY DISCLAIMER & WARRANTY DISCLAIMER
TTB uses commercially reasonable, industry‑standard safeguards to protect the platform and user information. However, users acknowledge and agree that:
- No system, platform, or transmission method is 100% secure, and TTB cannot guarantee absolute security.
- TTB does not guarantee error‑free, uninterrupted, or continuously available service, and access may be affected by maintenance, outages, third‑party failures, or circumstances beyond TTB's control.
- The service is provided strictly "AS IS" and "AS AVAILABLE," without any warranties of any kind.
- To the fullest extent permitted by law, TTB disclaims all warranties, whether:
- Express,
- Implied,
- Statutory, or
- Arising from course of dealing or usage,
including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, reliability, uptime, security, or non‑infringement.
- No oral or written advice, guidance, or communication from TTB creates any warranty unless expressly stated in writing and authorized by TTB.
- Users assume all risks associated with accessing or using the service.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by Ontario law, TTB's total liability for any claim arising out of or relating to the service is limited to the greater of: (a) $0, or (b) the total amount of TTB's own platform fees actually paid by you to TTB in the twelve (12) months preceding the event giving rise to the claim.
For clarity, "TTB's own platform fees" refers exclusively to TTB's handling fees and does not include, without limitation, rent amounts, housing payments, service fees, credit‑card processing fees, pass‑through charges, or any other amounts collected and forwarded by TTB on your behalf.
To the fullest extent permitted by law, TTB is not liable for any:
- Lost profits, loss of revenue, or loss of business
- Indirect, incidental, special, exemplary, punitive, or consequential damages
- Failures, errors, or delays caused by third‑party service providers, banks, networks, or processors
- Data loss, downtime, system interruptions, or inability to access the platform
- Disputes between tenants, landlords, or their authorized representatives
- Unauthorized access or misuse of the service resulting from user negligence, weak passwords, or failure to secure login credentials
9. SUSPENSION & TERMINATION
TTB may, at its sole discretion and without prior notice, suspend, restrict, or terminate any account or access to the service for any reason permitted by law, including, without limitation:
- Suspected or confirmed fraud, misuse, or attempted circumvention of verification or security controls
- Violations of these Terms, platform policies, or any applicable laws or regulations
- Failure to complete identity or document verification under Anti‑Money Laundering (AML) or Know Your Customer (KYC) requirements
- Regulatory, compliance, or risk‑management obligations requiring TTB to pause or restrict activity
- Use of inaccurate, false, or misleading information
- Activity that may expose TTB, users, or third parties to financial, legal, or security risk
TTB is not liable for any losses, delays, or consequences resulting from suspension or termination actions taken in accordance with this section.
10. GOVERNING LAW
These Terms, and any dispute, claim, or proceeding arising out of or relating to the service, your use of the service, or your relationship with TTB, are governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice‑of‑law or conflict‑of‑law principles that would result in the application of the laws of any other jurisdiction.
11. MANDATORY ARBITRATION
11.1 Binding Individual Arbitration
Any dispute, claim, or proceeding arising out of or relating to these Terms, your use of the service, or your relationship with TTB shall be resolved exclusively through binding individual arbitration, rather than in court. No judge or jury will be involved, and court review of an arbitration award is limited.
11.2 Opt Out Window
You may opt out of arbitration within 30 days of first accepting these Terms by emailing: contact@gottb.ca
11.3 Arbitration Opt Out
If you do not opt out within 30 days, arbitration is mandatory.
11.4 Class Action Waiver
To the fullest extent permitted by law, you agree not to:
- participate in class actions
- bring representative or collective claims
- consolidate your claims with others
All arbitration must be conducted on an individual basis only.
11.5 Venue & Rules
- Seat of arbitration: Ontario, Canada
- Governing rules: ADR Institute of Canada Arbitration Rules
- The arbitrator has exclusive authority to interpret and enforce this arbitration clause, including questions of scope, validity, and arbitrability.
11.6 Exceptions
TTB may seek relief in court for:
- injunctions
- orders to prevent fraud or misuse
- emergency or security‑related measures
These actions do not waive TTB's right to require arbitration for all other disputes.
11.7 Severability
If any part of this arbitration clause is found unenforceable, the remaining portions shall remain in full force and effect.
12. CHANGES TO TERMS
TTB may amend, modify, or update these Terms, the Privacy Notice, or any related policies at any time, with or without notice, to reflect operational, legal, or regulatory requirements. Your continued access to or use of the service after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service.
